Ing. Branislav Kysel - Kiskitrains, with registered office at Partizánska 354/35, Bošany 95618, Slovak Republic, IČO: 56387105, (hereinafter referred to as the "Trader") is the controller of personal data pursuant to Article 4 point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
2. Person concerned
The affected person is the Buyer or the Visitor of the site, because his personal data is provided by the Trader processes.
3. Personal data
Personal data are any data on the basis of which the data subject is identified or identifiable. The scope of the personal data that the Trader processes depends on the purpose for which the personal data are processed. We do not process special categories of personal data that are particularly sensitive (data revealing racial or ethnic origin (thus nationality, data revealing political opinions, data revealing religious or philosophical beliefs, trade union membership / only for the purpose of fulfilling legal obligations under the Labour Code, genetic data, biometric data, data concerning health and data concerning sex life or sexual orientation) cannot be processed).
4. Lawful basis and purpose for processing personal data
The Buyer or visitor to the site provides his/her personal data to the Trader, in particular the Contact Data (First name, Last name, address, e-mail, telephone contact). The Buyer or site visitor provides personal data to the Trader voluntarily for the purpose of further communication with the Trader. Without their provision, the Trader cannot properly perform the pre-contractual relationship and/or contract with the Customer and therefore it will not be possible to conclude it with the Buyer. The purpose of processing this personal data is to communicate with the Buyer, to issue a tax document, pre-contractual relations and identification of the Buyer, to carry out marketing and statistical activities, to inform about promotions, news and discounts.
If the Buyer and/or visitor places an order or fills in any form containing his/her personal data on the Trader's website, he/she also grants consent to the processing of his/her personal data.
5. Sources of personal data
The buyer and/or visitor to the website agrees to the processing of personal data through the website. The Buyer and/or the website visitor may, by ticking the relevant box, consent, within the meaning of the Data Protection Act, to the processing and storage by the Trader of their personal data, in particular those listed above and/or which are necessary for the Trader's activities.
6. Data retention period
The Buyer and/or visitor to the Website grants the Trader this consent:
- for the period necessary for the exercise of the rights and obligations arising from the contractual relationship
- for the period strictly necessary for the performance of the services
- for an indefinite period or until revoked in writing.
7. Withdrawal of consent
The consent to the processing of personal data may be withdrawn at any time in writing by the Buyer and/or the visitor to the website. The consent shall expire within 1 month from the date of delivery of the Buyer's and/or website visitor's withdrawal of consent to the Trader at the Trader's registered office address.
8. Recipients of personal data
The Trader processes personal data primarily for its own purposes. In addition, he may provide personal data to his business partners, in particular for the purpose of fulfilling contractual relations between the Trader and the Buyer.
9. Method of processing personal data
The Trader processes personal data electronically or in paper form (e.g. contracts, accounting and tax documents, correspondence in paper form) in systematically organised records.
10. Conditions for securing personal data
The Trader declares that personal data will be collected solely for the purpose of processing personal data.
The Trader declares that personal data of third parties obtained through contractual relations with the Buyer are equally covered by this Privacy Policy and are used solely for the purpose of fulfilling contractual relations with the Buyer.
The Trader shall not be liable for violations of third party privacy policies caused by the Buyer.
The Trader declares that he/she will ensure that personal data is processed and used only in a way that is appropriate to the purpose for which it was collected.
The Trader declares that it will process personal data in accordance with good manners and will act in a manner that does not contravene generally binding legislation.
The Trader declares that only persons authorised by the Trader and persons involved in the business cooperation have access to the personal data, which thereby fulfils the very essence of the service.
11. Final provisions
The Buyer or the visitor of the site, by expressing his/her consent on the Trader's site, confirms that he/she has voluntarily given the above-mentioned consents to the Trader and is entitled to withdraw them at any time in writing. As a Buyer or site visitor, he also declares that he has been informed of the terms and conditions of the processing of personal data.
The Trader is entitled to change these conditions. It will publish the new version of the Privacy Policy on its website.
These rules were created to clarify the protection of personal data and to strengthen transparency in the processing of personal data.
These rules shall come into force on July 13, 2024
